A special thank you to the Palm Coast Observer for publishing our recent news release regarding the signing of the COVID Liability Legislation by Governor DeSantis. SB 72 was the first bill signed in to law by Governor DeSantis during the 2021 Florida Legislative Session. This bill protects businesses from frivilous COVID-19 liability lawsuits if the business followed CDC protocols during the pandemic.
If the business did not follow CDC protocols, such as employees wearing masks, sanitizing or washing hands, those businesses may be subject to a COVID-19 liability case. However, the burden of proof rests on the plaintiff to prove the business was not in compliance – a fair middle-ground for those customers or employees who believe they contracted COVID because the business did not follow CDC protocols.
